PLEASE CALL FOR THIS SCUMBAG's IMMEDIATE REMOVAL FROM OFFICE! There MUST be some mechanism for such, when a (even, uh, ...'elected' (yeah, right?)) ..'leader'... advocates in any way this kind of heinous crime!! Here's a log that "burned" in April, '05:
Let me preface the following note by stressing that, in the past I have found officers of the Ithaca Police Department most helpful in a huge variety of cases, including several serious assaults by errant 'motorists'. In all of those instances the officers knew the law and showed considerable understanding of issues with bicyclists' safety. For these instances I am most grateful. And as far as I could see, the Ithaca Police Department always had a good relationship with the community, and were looked upon favorably. I hope that that basically hasn't changed, but you'd never have guessed it from what I experienced on Friday, 4/8/05.
On that day, at 10 a.m., a certain police officer,
who was SUPPOSED to be protecting us and upholding the laws of the land, instead spent a sizable portion of the morning harassing and issuing a citation to me, a law abiding cyclist, trying to force me to ride in an extremely unsafe manner on a network of roadways which it is hard to believe were not formulated with the intention of causing the death of as many cyclists as possible. Because I would not ride in an unsafe manner, since I know the New York State vehicle laws do not require me to do so, this officer ISSUED ME AN ILLEGAL CITATION, trying to SCARE ME INTO riding in an unsafe manner. (I did not even realize immediately what he was trying to force me to do, finding it hard to believe that a police officer was actually commanding me to do ssmething that would make it highly likely that I would be killed, given my past observations and experience)
The New York State traffic code is very clear on this.
Section 1234 reads:
"Section 1234. Riding on roadways, shoulders, bicycle lanes and bicycle paths.
(a) Upon all roadways, any bicycle shall be driven either on a usable bicycle lane or, if a usable bicycle lane has not been provided, near the right-hand curb or edge of the roadway or upon a usable right- hand shoulder in such a manner as to prevent undue interference with the flow of traffic except when preparing for a left turn or when reasonably necessary to avoid conditions that would make it unsafe to continue along near the right-hand curb or edge. Conditions to be taken into consideration include, but are not limited to, fixed or moving objects, vehicles, bicycles, pedestrians, animals, surface hazards or traffic lanes too narrow for a bicycle and a vehicle to travel safely side-by-side within the lane."

__On Friday, April 8. 2005, I was riding on Seneca Street, a one way, two- lane street, where traffic was light. I was between Meadow and Fulton. The light ahead was red, with a line of cars at a standstill. There were no parked cars on either side of the street.. However, there were on the right side of this street numerous drain grates, and the usual rocks and pieces of debris that make it unsafe or damaging to ride on.
_At that time a car came up and stayed close behind me. I became wary, as drivers who tailgate so long often do dangerous things. There was plenty of room in the other lane for this car to pass, if this was the intent of the driver. Thus, to be safe, and considering the road surface situation, as well as the low traffic conditions, I rode far enough from the curb that the driver of the car would easily see me and recognize that this was no place to try to "squeeze by" at the risk of my life. At this point, the driver pulled up alongside of me. To my surprise, he turns out to be a police officer (officer Wright) who began yelling at me to ride on the side of the road. I told him that I did not feel comfortable doing so under the prevailing conditions. At this point, the officer turns on his flasher and orders me to pull over, get off my bike, and to stand in front of his car. He then immediately proceeded to write the citation. I tried to point out to him that the law clearly allows for a cyclist not to ride near the right hand curb or edge of the roadway when reasonably necessary to avoid unsafe conditions (NY State Traffic Code, Section 1234). Seemingly not listening nor giving consideration to anything I said, his only verbal response was to volunteer his personal opinion that he would understand if drivers, frustrated by my 'slowing them down', would try to run me off the road. With this surprisingly offensive statement, officer Wright left me with my frustration and the citation.
Here is the section of the NYS traffic code that applies:
"Section 1234. Riding on roadways, shoulders, bicycle lanes and bicycle paths. (a) Upon all roadways, any bicycle shall be driven either on a usable bicycle lane or, if a usable bicycle lane has not been provided, near the right-hand curb or edge of the roadway or upon a usable right- hand shoulder in such a manner as to prevent undue interference with the flow of traffic except when preparing for a left turn or when reasonably necessary to avoid conditions that would make it unsafe to continue along near the right-hand curb or edge. __The feeling that certain automobile operators seem to have, of 'being slowed down by bikes'... is a completely false notion. This is due to the vast amount of road space taken by a car. In times of "heavy traffic" I probably speed up traffic considerably by being on a bike instead of in a car, even if I must sometimes take a full lane. When there are even just a few bikes, even though traffic flow is substantially improved, certain automobile users see something-- a cautious cyclist, to which they can attribute this falsely conceived 'slowness'. Note that this analysis assumes bikes are being ridden in traffic and not along the very edge of the road.
__As the reader has no doubt noticed, an uncomfortably large percentage of automobile drivers seem to think they are going too slow MOST OF THE TIME. But crash, death, and injury statistics irefutably and repeatedly tell us the opposite-- that, in fact these drivers must be ALMOST ALWAYS GOING TOO FAST!
__Note: When there is a bikelane, or a large enough lane which is obstacle-free all the way to the curb (neither of which is the case on Cayuga Street), each bike represents the near removal of an entire car from the traffic pattern, providing an even greater reduction in traffic. (you'd think this would be a strong motivation for the city to build safe, efficient bike lanes on all major roads!)
__This officer gave a citation to a person who had committed no crime.
Officers who commit sich offences should of course be dismissed from the force. This officer's crime could cause me to think twice about being careful in a dangerous situation, resulting in my death, or at least, serious injury, if I happen to be very lucky. (On the other hand, I have observed an officer watch an automobile blatantly run a stop sign right in front of him, and take no action.)
__I have not been injured or nearly killed (though I have had my bicycle run over by a malicious driver and was hit and knocked down with a car door, receiving some injuries, by another), since I made the decision to be completely careful, and to not automatically allow motor vehicle operators to risk my life to save two seconds, or to get ahead of me in a line of cars. Before I became as careful as I am now I had several injuries and close calls caused by negligent drivers; these still occasionally occur if I let down my guard, which is easy for me to do, since I am by nature, to which all the people who know me will attest, a most considerate person.
Thus, if I am killed by a car, I hereby declare that the driver is guilty of clearly intentional murder, and should be brought to appropriate justice! That is my last will and testament. Otherwise the killers would have to live with that mark, as it were, on their lives. There is no excuse for such a viciouis, demonic crime. Society, to further civilization, must no longer condone such overt violence.
UPDATE--- Of course they turned a blind eye.
The court threw the case right out, but that's not satisfactory to me, at this point. I spent an entire afternoon having to go down to town in ...'good'.... clothes, sit in the courtroom being forced to listen to case after case, then having to give a little talk.. and I didn't get paid a cent. I intend to pursue this farther, so that at least this kind of thing stops happening. And think how many LEGITIMATE tickets this guy could have given to truly dangerous 'motorists' in the time he took to illegally detain me! I should be re-inbursed for that time, at the very least!
OK- now we got that off our chest... So, going on...--

It happened AGAIN, on Friday, 5/13/05 approx2:30 p m ! A supposed 'police officer' that must have been buddies with officer Wright-- they must have cut the same classes...) was following me on the part of East Street which lies East of where Mitchell Street turns off. There were big trucks and much traffic in the oncoming lane. There were big trucksand other vehicles, for a while. Then a break occurred in the traffic, and this supposed ..'officer'.. pulled up along side of me and, in a fashion not too unlike that of officer Wright (I'm not COMPLETELY sure, actually, that it wasn't officer Wright, though it seems unlikely he would put his job this much at risk, havng learned about the law before, most hopefully..), proceeded to harass me, including the ludicrous suggestion that I "ride on the side walk", which ended only a few hundred feet down the road! (not to mention was not at all contiguous even up to that point,
from town (which this ..'officer' did not even seem to know, either..))... When I told him it was against the law, he said he was giving me special permission. "So is it ok to smoke pot if a police officer gives me 'special permission'"? I asked; ";you are telling me I can do something illegal as long as you tell me it's ok? Hmmmmm! All this went right by him and he tried this approach: He said, "Well I just don't want to be scraping you off the pavement", and " it's not my fault if You get killed"-- NOW WAIT A MINUTE-- DOES THAT MEAN THIS ,uh, ...'officer'... IS THREATENING NOT TO DO ANYTHING IF SOMEBODY ILLEGALLY KILLS ME WITH A DEADLY INSRUMENT? ISN'T THAT PART OF the JOB DESCRIPTTION, for a "law enforcement officers"...? Or is he in fact inferring that he just might decide to run me over if I'm holding him back', not letting him try to squeeze by when it would be very difficult to do so without killing me? THIS IS CLEAR GROUNDS FOR HIS DISMISSAL!
WHERE ARE THEY GETTING THESE JOKERS?
Again, these incompetent ...'law enforcement officers'.... are ENDANGERING CYCLISTS LIVES, LEADING CYCLISTS and MOTORISTS ALIKE TO DRIVE IN EXTREMELY UNSAFE WAYS. IF I AM KILLED BY A CAR, EVEN IF ONE OF THESE ignorant 'policemen' is not at the wheel, I WAS PROBABLY INADVERTENTLY RIDING IN AN UNSAFE MANNER BECAUSE OF THEIR ILLEGAL HARASSMENT OF ME. THUS THEY MUST ALSO BE BROUGHT TO JUSTICE FOR SUCH A MURDER ("..murder.?, you ask-- YES, knowingly taking the life of another human being- this includes putting others at unreasonable risk!)
_ OF COURSE, they ultimately will meet justice, by the law of "what comes around goes around; the law of deep causual connection! They will be far better off if they are called to task for this now. I have done my best- I called the chief and described what happened the best I could. I hope that these errant officers are corrected before they have much real blood on their hands; who knows how much they have already! (so THAT log is STILL burning; its gonna be pretty hard to put that fire out!

And, speaking of such where does all this leave us musicians?
Well, once upon a time, the biggest scumbags always used musicians to
help generate "fervor". In particular, brass bands evoked a sense of
militancy, of 'inevitable progress'; of ..'victory'
But now we have "sound bites"! Who needs musicians any more? Now
studies of the effects of various ..'sound bites' can be computer-
generated,
tested, and the 'most effective' (meaning, those inhibiting logical
thought and independent thinking) can be ...'determined'.... And these

successful'..sound ..'bites' can be widely disseminated at almost no cost!
(--so I guess I could become a ..'sound bite'... artist and prostitute
myself that way, but no thanks--

BALLOTS counted by REAL HUMANS, with double and triple checks against

folks who prepared the results of polls- but you can only do so much of
this stuff before somebody "spills the beans"- thus I think they were
hoping that if they worked on raising doubts about the polls' accuracy,
that would be good enough. So that's
what they're trying now. However, they might have a hard time with this
one. It's typical of criminals that they desperately come up with more
and more far-fetched ...'explanations' when evidence starts leaking
out.)

The United States Congress kills far more Americans than terrorists
do. 18,000 Americans die yearly because 40,000,000 of us can't afford
health insurance. 440,000 Americans are killed yearly by the tobacco
industry,
helped by tax breaks. Thousands of Americans are murdered on 'amerika's
roads yearly, while railroads lose funding. The weakening of urban air

Zero Population Growth-- Now
here's a group who notices that population growth is the most pressing issue
for human beings at this time-- the way things are rapidly going, if we DON'T
take the bull by the horns and completely reduce our population growth to 0
(preferably less!) within the next 50 years, we will witness (and be part
of!...) the most intense misery ever faced by humanity. It is interesting to
observe that the use of ANY MEANS POSSIBLE, to prevent this catastrophe will
probably cause less suffering than to do nothing, or less than nothing (as the
so- called
"conservative" (certainly a misnomer here!) politicians say they
want...(perhaps having interpreted certain religious teachings with a
nihilistic twist...)). Of course I'm too much of an optimist to advocate
violence in any way, but if our numbers increase much more our very
existence becomes violence by definition!

Also, next time there is an important speech that should be recorded, I
believe the americans with disabilities act (passed when we had a
freely, (or at least, a little, more freely than today...) elected government)
may allow people who, for example, have memory impairment due to an injury or
illness, to tape such speeches freely-- thus it may may be harder for them to
deny such a person's rights. Then tapes would be in existence, and could even
be
subpoenaed to be heard-- ...but isn't there some kind of 'freedom of
information act'?
